Village of Lake James is on Joint Commission's agenda

The Joint Legislative Commission on Municipal Incorporations will discuss the proposed Village of Lakes James at 5 p.m. Wednesday in Room 544 of the Legislative Office Building.
The commission advises the General Assembly on the creation of new towns and cities.
The commissioners will receive a Phase II report on the proposed village's incorporation from Lee Nichols, a community development planner in the N.C. Department of Commerce's Division of Community Assistance.
A Phase II report addresses a proposed municipality's compliance with the General Statutes' requirements in Chapter 120's sections 160 (the new municipality's proximity to other towns and cities), 167 (population size and density), 168 (developed land use, such as residential, commercial, etc.), 169.1 (which includes fiscal impact on other municipalities and the county) and 170 (proposed tax rate and services).
According to the agenda, the Joint Commission also will consider whether the area covered by the proposed village is contiguous. The question arises because a map of the proposed village shows two areas divided by the waters of Lake James.
Finally, the commission will discuss whether to have a public hearing about the proposed village.
If commissioners decide no hearing is necessary, they may consider making a final recommendation to the General Assembly.
Sen. Jim Jacumin's bill to create the Village of Lake James has been parked in the Senate Finance Committee since March. The legislature usually does not act on a bill for municipal incorporation until it receives a recommendation, either pro or con, from the Joint Legislative Commission.
In addition to considering the petition for the Village of Lakes James, the commission will discuss a petition to create the town of Swannanoa in Buncombe County.
The commission's meeting is open to the public, but it is not a public hearing and members of the public may speak only if recognized by the commission.
