RALEIGH
A group opposing state incentives for corporations has told the North Carolina Court of Appeals the taxpayers it represents should be able to challenge tax breaks used to lure Google to Caldwell County.
The News & Observer of Raleigh reported the North Carolina Institute for Constitutional Law argued before a three-judge panel Monday. The group wants to overturn a lower court ruling that the three taxpayers don't have the right to challenge the law.
Lawyers for Google and the state say the taxpayers failed to show they were discriminated against and urged the judges to uphold the lower court ruling.
Lawmakers approved exemptions from the state's retail sales and use tax, worth an estimated $90 million over 30 years in exchange for Google building an Internet data center in Lenoir, creating up to 210 jobs.
